LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT
FOR PARTICIPATION IN ACTIVITIES ORGANIZED BY SCRUM DOG MILLIONAIRES, LLC
PLEASE READ CAREFULLY BEFORE SIGNING – THIS IS A LEGALLY BINDING DOCUMENT
In consideration for being permitted to participate in activities organized by Scrum Dog Millionaires, LLC (hereinafter "SDM, LLC"), including but not limited to rugby training, matches, events, and related activities (hereinafter "the Activities"), the undersigned, for themselves, their heirs, executors, administrators, personal representatives, successors, and assigns, hereby acknowledges and agrees to the following:
1. Assumption of Risk: I understand and acknowledge that participation in the Activities involves inherent risks, dangers, and hazards that may cause serious injury, including but not limited to physical injury, trauma, paralysis, disability, or death, as well as property damage or loss. These risks include, but are not limited to, those associated with physical exertion, contact sports, falls, collisions, equipment malfunction, environmental conditions, and the actions or inactions of other participants. I voluntarily accept and assume all risks, known and unknown, arising from my participation in the Activities, even if arising from the negligence of the Released Parties (as defined below).
2. Release and Waiver of Liability: I, for myself and on behalf of my heirs, executors, administrators, personal representatives, successors, and assigns, hereby irrevocably and unconditionally release, waive, discharge, and covenant not to sue Scrum Dog Millionaires, LLC, its members, managers, officers, directors, employees, agents, volunteers, and representatives, as well as the City of Arroyo Grande, California, and the County of San Luis Obispo, and their respective departments, agencies, officials, officers, employees, agents, and volunteers (hereinafter collectively referred to as the "Released Parties"), from any and all claims, demands, causes of action, liabilities, suits, judgments, damages, expenses, and costs (including attorneys' fees) of any kind or nature whatsoever, whether in law or equity, whether known or unknown, foreseen or unforeseen, arising from or relating to my participation in the Activities, including, but not limited to, those arising from the negligence, gross negligence, or strict liability of the Released Parties.
3. Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, liabilities, suits, judgments, damages, expenses, and costs (including attorneys' fees) incurred by the Released Parties as a result of or arising from my participation in the Activities, or from any breach of this Agreement by me.
4. USA Rugby Union Claims: I understand and agree that any claim, dispute, or grievance related to my participation in the Activities, particularly those involving on-field incidents or disciplinary matters within the sport of rugby, must be submitted to and resolved through the appropriate procedures and tribunals of the USA Rugby Union, in accordance with their bylaws, policies, and regulations. This includes, but is not limited to, injury claims, disciplinary actions, and eligibility disputes.
5. Medical Treatment: I authorize Scrum Dog Millionaires, LLC, or its representatives, to seek and obtain medical attention on my behalf in the event of an emergency during my participation in the Activities, and I agree to be solely responsible for any and all costs associated with such medical attention.
6. Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
7. Governing Law and Venue: This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts located in San Luis Obispo County, California, or the appropriate federal court located therein.
8. Acknowledgement of Understanding: I have read this Liability Waiver, Release, and Assumption of Risk Agreement carefully, understand its terms, and acknowledge that I am giving up substantial legal rights by signing it. I am signing this Agreement freely and voluntarily, without any inducement or assurance, and intend for it to be a complete and unconditional release of all liability to the greatest extent permitted by law.
